Elementary and Secondary Education Act (ESEA) Reauthorization 2002

 

Title I A –

To improve achievement of disadvantaged (now used much more broadly)

 

This section includes the new standards, required assessments, the adequate yearly progress (AYP) requirements [that could place a district in "school improvement", "corrective action" or "restructuring" yielding public and private options for parents and students]. Within district targeting and school-wides remain. Funding setasides are required to provide transportation, choice and supplemental services (not more than 20% totally). A 1% setaside is required to promote / encourage parent involvement. The act now requires an Annual Report (this closely parallels Michigan’s report). The new act provides a phase-in for all core teachers to be fully certified (by 2005-06) in the area in which they are teaching and at the appropriate grade level. The section further requires all para-professionals to have two years of post-secondary study, hold a two-year degree or to meet a "high rigorous standard" which will be defined in the regulations or by SEAs.

 

 

Title I B – Literacy

 

This section includes the Reading First and Early First Reading as well as the Math / Science initiatives. There is some flexibility to this program but the Administration is pushing phonics.

Title I E – National Assessment of Title I

Title I F – Comprehensive School Reform

Title I G – Advanced Placement Programs

Title I H – School Dropout Prevention

 

 

Title II A– Teacher and Principal Quality

 

This is a roll-up of the former Eisenhower and Class Size This is the funding section; teacher and para-pro requirements are detailed in Title I Part A.

 

Title II B – Math and Science Partnerships

Title II C – Innovation for Teacher Quality

 

This includes Part A – Troops to Teachers, Part B - Transitions to Teaching (for mid-career professionals), Part 2 – the National Writing Project, Part 3 Civic Education, part 4 Teaching Traditional American History among other sub-titles

 

Title II D – Enhancing Education through Technology

Title III – Limited English Proficiency

 

Part A deals with provision of a language instruction program for students of limited Enqlish proficiency and immigrants; Part B deals with improving such programs.

 

Title IV – Safe and Drug Free Schools  (A) and 21st Century Learning Centers (B)

 

 

Part A rolls most of current SDFS language into the act; however there is new language that provides an "unsafe school choice option" to a parent "whose child is being educated in a "persistently dangerous" learning environment" and requires the district to "coordinate transportation" to a "safe school" within the LEA including "charter school" options.

 

Part B creates a new section for 21st Century Learning Centers which is the public and private school option for districts that are in "school improvement", "corrective action" or "restructuring" as well as other programs. This section requires data collection (the Governor’s language to legitimize SRSD) and specifically states the choice option noted above relative to "persistently dangerous" learning environments. The grants have increased (from previous innovative programs) from $35,000 to $50,000 and it includes expanded use of funds. This is the section that includes some troubling language opening instructional services to for-profit, non-profit, community-based organizations, etc.

 

 

Title V – Promoting Informed Parent Choice and Innovative Programs

 

Part A provides for Innovative Program grants; Part B provides for Charter School programs and facility funding; Part B subpart 3 provides for Voluntary Public School Choice Programs; Part C provides for Magnet Schools Assistance; Part D provides for the Fund for the Improvement of Education (promoting reform, improve parent and community involvement, improve elementary counseling, Character Education, smaller learning communities, RIF, Gifted and Talented, Star Schools, Ready to Teach – promoting virtual learning, foreign language, physical education, community technology centers, native American programs, Excellence in Economic Education, improve children’s mental health, arts education, family information centers, combating domestic violence, health schools, special grants to provide capital expenses to provide equitable services to private school students, Women’s Educational Equity Act

 

 

Title VI – Flexibility and Accountability

 

Part A deals with local and State flexibility provisions (up to 50% of other titles except Title I can be shifted out of that Title to other Title programs – an LEA can only shift INTO Title I Part A); Part B is the Rural Schools Initiative

 

 

Title VII – Indian Education

 

 

Title VIII – Impact Aid

 

 

Title IX – Definitions (Part A), Flexibility Provisions (Part B)

 

Part C includes requirements for the Consolidated Plan, Part D includes languages for Waivers, Part E sets forth requirements for participation of private school children and teachers (Sub Part 2 in Sec. 9632 sets forth the requirement for Unsafe School Choice Options), Part F includes the Evaluation requirements

 

 

Title X – Miscellaneous

 

Part A covers Repealers, Part B Redesignations, Part C Homeless the McKinney Homeless Act has been amended by reference to require LEAs to designate a "homeless liaison", require the coordination of transportation for homeless students, require immediate enrollment (even without required student records) and to require public notice where homeless individuals would become aware of educational services for which they are entitled], Part D Native Americans, Part E Higher Education Act references relative to Teacher Quality, and Part F General Education Provisions (where the requirement re: parent notice regarding "invasive exams" or other physical education exams that are required)
